The TRUTH on Prop 8

This is why I am voting YES on Prop 8

This information is found in the California Code

So I checked on Domestic Partnerships and this is what I found…

Family Code 299.2

299.2. A legal union of two persons of the same sex, other than a
marriage, that was validly formed in another jurisdiction, and that
is substantially equivalent to a domestic partnership as defined in
this part, shall be recognized as a valid domestic partnership in
this state regardless of whether it bears the name domestic
partnership.

Same sex couples who marry outside of CA are still recognized by law in the state of CA. Just like marriage

Family Code 298-298.6

This code explains when how a domestic partnership is established in CA, and also gives the rights to gay couples to change their names if they wish. Just like marriage.

Probate Code 6240-6243

This section answers questions regarding the proceedings upon a will if one of the members of the partnership dies. Its handled just like marriage

Government Code 70670-70678
This code instructs on the filing charged that are applied to marriage and domestic partnership. They are the same fees.

Family Code 297-297.5

This section of code is the BIG one. This explains what a domestic partnership is and the workings of one. It is the same as a marriage.

Family Code 299.6

This is a update pertaining to domestic partnerships to keep their rights current to ensure their well being.

Revenue and Taxation Code 60-69.5

This instructs how domestic partnerships are treated with the taxes of CA. again….just like marriage.

Probate Code 6120-6124
This is further instructions to domestic partnerships concerning the written will of one of the people in the partnership. Sounds like….marriage? ;-)

Probate Code 20-88

This section gives definitions concerning different matters of the Probate Code including what a domestic partnership is.

Government Code 22800-22826

This section talks about the retirement of government workers and how it affects people in domestic partnerships. Same rights as married couples.

Education Code 24300-24313
Talks about a retirement package in education. This is one law that does not cover domestic partners rights. But it has nothing to do with CA’s law, it has to do with Section 7 of Title 1 of the United States Code. And Gay marriage is not recognized federally due to the Defense of Marriage Act of 1996. So even if you vote no, it wouldn’t matter federally.

Probate Code 1900-1901
A notice about property, domestic partnerships treated the same as marriage.

Government Code 22760-22787
This section talks about insurance issues and has a clear definition of domestic partnerships. Treated just like marriage.

Public Contract Code 10295-10299
This talks about legal contracts. Its also treats domestic partnerships just like marraige.

Insurance Code 10110-10127.18
This section talks about health care and how they treat domestic partnerships. Yes, just like marriage.

Health and Safety Code 1367-1374.9
This section talks more about health care and its effects on domestic partnerships. Just like marriage

Are you seeing a pattern yet?

Business and Professions Code 6500-6502
This is the Professional Fiduciaries Act. It talks a bit about the rights of domestic partnerships.

Education Code 27400-27413
Here is an excerpt from this section

27400. (a) This chapter establishes the power of a court in a
dissolution of marriage or legal separation action with respect to
community property rights in benefits under this part and defines the
rights of nonparticipant spouses in the Cash Balance Benefit
Program.
(b) For purposes of this chapter, the termination, dissolution, or
nullity of a registered domestic partnership, or the legal
separation of partners in a registered domestic partnership, as
provided in Section 299 of the Family Code, shall be treated in the
same manner as a dissolution of marriage or legal separation of a
member and his or her spouse.

Probate Code 2850-2856

This section treats a domestic partnership just as a marriage.

Code of Civil Procedure 1275-1279.6
This section also treats domestic partnership like a marriage.

Family Code 2330-2348
This instructs on the dissolution of marriage or a domestic partnership. Both treated equally.

Education Code 22650-22666
This code further shows the equality of domestic partnerships and marriage.

Government Code 21620-21635.5
Again this section talks about the death and how the courts handle the surviving member or spouse of a marriage and a domestic partnership. The same way.

Revenue and Taxation Code 18501-18572
This talks about filing taxes in a domestic partnership.

Government Code 31760-31768
This section talks about retirement and the effects on the domestic partner. Married spouse and Domestic partner treated the same.

Government Code 31780-31792
This section talks about death and the effects on the domestic partner. Married spouse and Domestic partner treated the same.

Corporations Code 1800-1835
This one instructs about marriage and domestic partnership in a business situation. Treated equally

Code of Civil Procedure 377.60-377.62
This one talks again about death and the effects on the surviving partner or spouse. You guessed it, treated the same.

Education Code 25000-25000.9
This sections refers to domestic partnerships.

Government Code 14770-14775
This code includes domestic partnership with the same regard as to marriage.

Family Code 350-360
This one talks about making a brochure for domestic abuse in straight and gay households. Both are treated equally.

So there is ample evidence that Gay couples in a domestic partnership have ALL the same right and privileges as heterosexual couples in marriage.

saying no on prop 8 doesnt make any sense because gay couples already have all the right they are fighting for. So the question is what are they really fighting for? If not for rights, then for what?

Saying YES to Prop 8 does makes sense because they are fighting for the definition of marriage, they are NOT opposing gay rights in any way, shape, or form. Saying YES DOESN’T affect domestic partnerships, or their rights in ANY way.

Saying no to Prop 8 DOES affect how marriage in taught in schools according the California Code:

Education Code 51880-51881.5
This section is the Comprehensive Health Education Act of 1977. It states that forced marriage is taught in schools. You would have to teach that same sex forced marriage as well as traditional forced marriage.

Education Code 51930-51932
This is know as the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act. This act says it teaches about marriage and sexual orientation in the beginning and then denies it in the end. Either way you slice it, the definition of marriage will be taught or discussed at minimum.

Education Code 51890-51891

This is for comprehensive health education classes. Here is an excerpt.

(D) Family health and child development, including the legal and
financial aspects and responsibilities of marriage and parenthood.

They have to teach about marriage, if Prop 8 doesnt pass, then they must teach about same sex marriage as well, not as a domestic partnership, but as marriage.

Education Code 51933
(7) Instruction and materials shall teach respect for marriage and
committed relationships.

Again same point, different stature.

Seeing a pattern again?

Saying No on Prop 8 will change the way our kids are raised and taught in schools. Its in our laws to do so. And its our rights to enforce those laws.

Say Yes on Prop 8 because it not only ensures NO rights taken from the Gay community, but it protects the proper definition of marriage, between a man and a woman.

If Prop 8 doesnt pass, I want a bill that will let me have a domestic partnership to the opposite sex. Why not? It should be my right to have a domestic partnership. Anyone with half a brain will tell me that I have all the rights and privileges under marriage as I would under a domestic partnership.

Its the same scenario with reversed rolls.

Say Yes on Prop 8 for your children’s education sake.

Oh yeah P.S. dont forget if you do change the definition of marriage, you will be paying for it, because you have to change every single piece of law and code that we have which dates back over 100 years.

Thats lots of man power and tax dollars that could be used to better causes, such as health care, welfare, and other aspects to make ALL of our lives a bit easier.

So do it for your wallet, do it for your kids, or just do it because saying no does more harm then saying yes.

Sunday Night

Yesterday, Raven, Donyea, My father, and I went to an event at The Standard Hotel in Downtown Los Angeles. It was a beautiful day in southern California. A few clouds in the sky and a light breeze which made the 80+ weather a bit more bearable. Like usual, We took the elevator and Raven climbed the stairs, all 22 flights of them. It was on the rooftop. The view was breathtaking. It truly took the essence of downtown living to a whole other level. Pacific Division was there and I have to tell you, they are some stand up individuals, I had the pleasure of meeting all of them and spending some extra time with Mibs, B. Young and DJ Sean G. ( which we all ended up getting Chicken McNuggets after Cabana, but that’s a different story.)

We enjoyed the afternoon, watching people freestyle and meeting people from around the world. After our extravaganza at The Standard. We moved over to The Cabana Club in Hollywood CA. It was actually next to the Film School which was the sister school I used to be employed by. Luckily I found free parking that night ( my little secret on how I pulled off free parking in Hollywood on a Sat night, if you ever been to Hollywood, you would be impressed.) The line was very long, and there was some very attractive women that night. I don’t think they enjoyed watching Raven and I walk past all of them and enter the club without paying or waiting. But that is the difference between us and them. Between people who accept and people who achieve. This was my first time to the Cabana Club. It is a very nice venue and I recommend it to anyone looking for a upper scale club to attend in Hollywood. T

he music was a great selection of different hip hop hits of today and years past. Most of the crowd was boushy, but there was a few who said they weren’t, but were! (Remind me to never go to Rancho! Real estate appraisers front on you!) After the club as I stated earlier, we hit up McD’s for 50 chicken nuggets. I was impressed with the McD’s on Vine and De Longpre, they cooked all that and 2 orders of fries and a coke, and I only had to wait an extra 2min. Who has 50 chicken nuggets cooking right off the bat at 2am. Very cool! Then we ended up at Pac Div’s house and chilled there for a min. I met a nice woman there who is a writer for a music column of a few magazines. By this time it was 3am and we were all ready to go to bed. Most everyone was either faded or drunk and of course. I was totally sober and awake! Raven and I headed back to her apartment and I crashed on her couch with the A/C blowing directly in my face. It was one of the best 5 hrs of sleep that I have had in a long time. Yesterday I partied for 15 hours and loved every minute of it.

I am going to keep this going, talking about what is in the daily life of a producer, who knows, maybe Ill turn it into a movie or another Entourage, except with music!

Brotherhood Entertainment Collab

So this week was the beginning of a co-venture with Brotherhood Entertainment and Eklect Records. It has been a fun experience to be able to work with great artists and to collab on some great music. Currently we have 2 songs in the works right now. One with Cakes B, and the other with Cakes B and Lil Al B Sure on the hook. We will be working on more and then choosing which ones will go on this compilation album.

Im not that good at this blogging thing, perhaps when time goes on, they will improve.
